Litigation and dispute resolution 

DS Lawyers Canada's Litigation and Dispute Resolution team is made up of lawyers with varied and multidisciplinary experience.   • Civil and commercial litigation: We represent our clients in civil and commercial litigation, whether it involves the interpretation or application of contracts and/or contract disputes, shareholder disputes, real estate disputes, civil liability, debt recovery, bankruptcy, insolvency or restructuring, or any other type of dispute. Our strategic approach and solid advocacy experience enable us to defend our clients' interests with determination and efficiency. 
  • Intellectual property litigation: We have recognized expertise in managing and resolving intellectual property disputes in such areas as copyright infringement and trademark litigation. We work closely with our clients to protect their intellectual property rights and defend their market position.  
  • Dispute prevention and resolution methods: We actively encourage the use of dispute prevention and resolution methods such as negotiation, mediation, conciliation and arbitration, to achieve rapid, cost-effective solutions. Our qualified lawyers are trained to facilitate the process of amicable dispute resolution and help parties reach mutually satisfactory agreements. 
  • Administrative litigation or specialized tribunals: We also represent our clients in litigation involving government agencies (e.g. Canada Revenue Agency, Revenu Québec) or regulatory bodies, as well as before administrative and quasi-judicial tribunals. As such, our team is able to assist our clients, particularly in tax and/or employment and labour law disputes. 
  • Cross-border litigation: We handle cross-border disputes, whether commercial, contractual or of any other nature. Thanks to our global presence and our network of international partners, we can provide our clients with competent and efficient representation in cross-border disputes. 
  • Construction litigation: We have in-depth expertise in construction and tendering disputes, whether for commercial, residential, industrial or infrastructure projects. We represent a variety of parties involved in such disputes, including owners, contractors, subcontractors, material suppliers and professionals, and strive to protect their interests by making thorough and competent representations. 
  • Arbitration: Arbitration offers many advantages compared to traditional court proceedings, such as the speed of the procedure, the confidentiality of the debates, the ability to choose one or more arbitrators specialized in the relevant field, as well as the flexibility of organizing hearings. Our team of arbitration experts is here to guide and support you throughout this process. Our lawyers specialized in arbitration have recognized expertise in this field and will be able to advise you in a personalized way to best defend your interests.
  • Customs and international trade litigation: We handle disputes related to customs regulations and/or audits, including customs duties, import/export procedures, tariff classifications, origin of goods, transfer pricing and customs valuation. We assist our clients in managing and/or resolving customs disputes and ensure that their customs rights and obligations are respected. We also appear before administrative tribunals in the event of judicial review or arbitration in international trade investigations.
